These Terms and Conditions ("Terms") govern your use of the website, billing and operations platform, after-hours AI phone answering service, and related services (together, the "Services") provided by One Hour Onsite, LLC, doing business as OHO Connect ("OHO Connect," "we," "us"). By using the Services you agree to these Terms. If you are using the Services on behalf of a business, you represent that you have authority to bind that business.
1. Accounts
You must provide accurate account information and keep it current. You are responsible for all activity under your account and for keeping your credentials secure. Notify us promptly at support@ohoconnect.com of any unauthorized use.
2. The Services
OHO Connect provides telecom billing and operations software and an after-hours AI phone answering service. The after-hours service answers calls on behalf of a subscribing business, collects caller information, and delivers summaries to the business by email and, where enabled, by text message. The service is an automated assistant, not a human operator, and is not an emergency service. Callers with emergencies should contact 911 or the appropriate emergency service.
3. Fees and billing
Fees are stated at the time of purchase and billed in advance on a recurring basis unless otherwise stated. Trials, where offered, convert to a paid subscription at the end of the trial period unless canceled. Usage-based charges, if any, are billed in arrears. You authorize us and our payment processor to charge your payment method for all fees. Fees are non-refundable except as required by law or expressly stated in writing.
4. Cancellation
You may cancel a subscription at any time from within the Services or by contacting support@ohoconnect.com. Cancellation takes effect at the end of the current billing period. We may suspend or terminate the Services for non-payment, breach of these Terms, or use that creates risk or legal exposure for us.
5. SMS Terms
Program description. OHO Connect sends transactional text messages consisting of after-hours call alerts and summaries to enrolled business phone numbers, confirmation messages to callers who request them, and account verification messages. We do not send marketing text messages.
Consent. By enrolling a phone number and affirmatively agreeing to receive text messages, or by verbally requesting a text confirmation during a call and providing a mobile number, you consent to receive the messages described above at that number. Consent to receive text messages is not a condition of purchasing any goods or services.
Frequency and rates. Message frequency varies with call volume and account activity. Message and data rates may apply.
Opting out. Reply STOP to any message to opt out. You will receive a one-time confirmation message and no further messages. Enrolled numbers may also be removed within the Services at any time.
Carriers. Supported carriers are not liable for delayed or undelivered messages. Message delivery is subject to effective transmission from your network operator.
Privacy. Information collected in connection with text messaging is handled as described in our Privacy Policy. Mobile phone numbers and opt-in consent are not shared with or sold to third parties for marketing purposes.
6. Acceptable use
You agree not to use the Services to violate any law or regulation, including telemarketing and consumer protection laws; to send unsolicited messages; to transmit malicious code or interfere with the Services; to infringe the rights of others; or to misrepresent your identity or affiliation. You are responsible for obtaining any consents required from your own customers and callers for the collection and use of their information through the Services.
7. Customer data
You retain ownership of the data you and your callers provide to the Services. You grant OHO Connect a license to use that data as necessary to provide, secure, and improve the Services and as described in the Privacy Policy. You are responsible for the accuracy and lawfulness of the data you provide.
8. Intellectual property
The Services, including software, content, and trademarks, are owned by OHO Connect or its licensors and are protected by law. You may not copy, modify, reverse engineer, or create derivative works of the Services except as permitted by law.
9. Third-party services
The Services rely on third-party providers, including telecommunications carriers, messaging and voice platforms, payment processors, and hosting providers. We are not responsible for the acts or omissions of third parties, and their services are subject to their own terms.
10. Disclaimers
The Services are provided "as is" and "as available." To the fullest extent permitted by law, OHO Connect disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or that every call will be answered or every message delivered.
11. Limitation of liability
To the fullest extent permitted by law, OHO Connect will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or data, arising from or related to the Services. Our total liability for any claim arising from the Services will not exceed the fees you paid to us in the twelve months preceding the claim.
12. Indemnification
You agree to indemnify and hold harmless OHO Connect and its officers, employees, and agents from claims, damages, and expenses (including reasonable attorneys' fees) arising from your use of the Services, your data, or your breach of these Terms.
13. Governing law and disputes
These Terms are governed by the laws of the State of Ohio, without regard to conflict-of-law principles. Any dispute arising from these Terms or the Services will be brought exclusively in the state or federal courts located in Hamilton County, Ohio, and you consent to their jurisdiction.
14. Changes to these Terms
We may update these Terms from time to time. We will post the updated Terms on this page and update the effective date. Continued use of the Services after changes take effect constitutes acceptance of the updated Terms.
